The Netherlands wind turbine distance standard proposed by the Ministry of Infrastructure and Water Management would require new onshore turbines to be sited at least twice their tip height from residential areas, under draft regulations announced by State Secretary Annet Bertram in a letter to Parliament. The rule is intended, in Bertram’s words, to ‘offer certainty and clarity to citizens, local residents and administrators about the permitted distance between homes and wind turbines’ while enabling continued investment in renewables. The industry is not convinced it achieves either goal well.

The draft regulations are expected to cover noise and shadow standards in addition to the distance requirement. The Dutch government says a final draft will be sent to Parliament for consideration before the end of the year. Exceptions will be permitted ‘with sound justification’, Bertram said, including for repowering projects. The regulation will also be evaluated after five years ‘to see whether new innovations of wind turbines offer the possibility of adjusting the distance standard’.

Five years without national rules, and this is the result

Dutch renewable energy association NedZero offered a pointed two-handed response: yes, a national distance standard ends five years of regulatory uncertainty for the sector; no, it does not actually improve protection for residents. The organisation’s position is that a blunt fixed-distance rule is the wrong instrument, and the consequences for project design could undermine the efficiency of the entire onshore wind build-out.

NedZero argues that a fixed minimum separation will push developers toward smaller turbines rather than larger, more efficient machines. Larger modern turbines sit on taller towers and carry larger rotor diameters, meaning their tip height (and therefore their required setback) increases. Under a two-times-tip-height rule, a taller turbine demands more exclusion zone per unit of capacity installed. The commercial logic would, in some cases, favour shorter, less productive machines. NedZero also warns that the rule will reduce the total land area available for wind development, compounding the capacity constraint.

Jan Vos, Chairman of NedZero, was direct: ‘This is incomprehensible at a time when wind energy means so much to the Netherlands. Since the start of this energy crisis, our onshore wind turbines have already saved the Netherlands nearly 1 billion euros in gas imports.’ Vos added that in many locations turbines can be installed without causing nuisance, and called on the Cabinet to ‘come up with sound grounds for exemption as soon as possible’.

The exemption clause may be the regulation’s most consequential detail. Bertram has said exceptions will be permitted with ‘sound justification’, but NedZero’s position is that the Cabinet has not yet defined what that justification looks like in practice. Until it does, the clarity the regulation is meant to deliver will remain partial: developers will know the baseline rule but not the boundaries of the route around it.

That ambiguity matters most for repowering, the one exemption category Bertram named explicitly. Much of the Netherlands’ existing onshore wind fleet was built before modern setback debates began, meaning repowering projects will frequently involve sites where a two-times-tip-height rule, applied strictly, would prohibit a like-for-like replacement with a larger, more productive machine. If exemptions for repowering are narrowly drawn, the regulation could inadvertently lock in older, less efficient turbines rather than accelerating the transition to higher-output plant.

The Ministry of Infrastructure and Water Management has not yet published the full draft text. Parliament will have its opportunity to scrutinise the detail before the year is out, including whether the noise and shadow standards complement or contradict the distance requirement. NedZero has made clear it will press the case for a more flexible, site-by-site framework. The five-year review clause is the sector’s real long-term hope: that turbine innovation eventually makes the fixed-distance logic obsolete.
